About these Terms and Conditions:
Supreme Products is the trading name of Supreme (Equestrian) Products Limited.
In these Terms and Conditions ‘we’ or ‘Supreme Products’ means Supreme (Equestrian) Products Limited, UK registration 04444035, NZ registration 6190628 and ‘you’ means the user of the website found at www.supremeproducts.co.nz
'Order' means order submitted by you for products on www.supremeproducts.co.nz
'Products' or ‘items’ means the products offered for sale on www.supremeproducts.co.nz
Your access to and use of www.supremeproducts.co.nz is subject to these full Terms and Conditions. By accessing and using this website, you accept and agree to these Terms and Conditions without any limitation or qualification.
These Terms and Conditions together with your order, order confirmation and order dispatch constitute the entire contract between Supreme Products and you for the supply of products you have ordered. No other Terms and Conditions will apply.
Pricing and payment
All prices are shown and processed in New Zealand Dollars. Supreme Products reserves the right to amend pricing without prior notice.
Payment is to be made in full when placing an order. No credit account will be entered in to. Payment can be made by Visa, MasterCard (debit or credit card), Discover or American Express. All prices are correct at the time of publishing the website.
When the order is placed on our website, payment is made via PayPal and can be processed using a PayPal account or by using PayPal’s secure encrypted credit card payment facility. At no time in the payment process does Supreme Products have any visibility of any customer card details. They are not held in clear text on any web site.
We will never contact you by telephone to request credit card details. Under no circumstances should you ever provide your credit card details over the telephone or via unsecure email to anyone claiming to be an employee or affiliate of Supreme Products.
Correction of errors and inaccuracies
Supreme Products reserves the right to correct any errors, inaccuracies or omissions on the website and to change or update information at any time without prior notice (including after you have submitted your order).
Use of the website
We will use all reasonable endeavours to ensure that the website operates reliably and consistently but does not warrant that the use of the website will be uninterrupted or error-free or that the website is free of any virus or other harmful elements.
Acceptance of your order
Supreme Products reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders at their discretion. Your order will only be confirmed upon dispatch when an email notification will be sent to you. If Supreme Products is unable to process or accept your order after payment is received, you will be contacted and your options will be explained to you (refund or exchange).
You have the right to cancel your order within fourteen (14) days of the invoice date. Should you wish to cancel your order, please download and complete a returns and exchanges form and include it in your parcel. Products will be inspected upon receipt and if found to be in an ‘as new’ condition, a refund will be processed for you. Please seek proof of posting for any items you return. Items should be returned to Supreme Products, PO Box 594, Pukekohe, 2340. Please allow 10 days from the date of shipping to facilitate inspection and refund.
The entire website, copy, images, logos, trademarks and content is owned by Supreme Products. You are not permitted to copy, reproduce, adapt, publish or distribute the material contained without the prior written permission of Supreme Products.
All items will be sent by courier and we aim to dispatch within 2 working days of the date of your order provided the product is in stock. Please allow 2 – 3 days for delivery to non-rural destinations and 4 – 5 days for delivery to rural destinations. Supreme Products only ships to delivery addresses in New Zealand.
Title and Risk
Title and risk in the products passes to you when they are delivered to the delivery address indicated in your order.
Returns and exchanges
If you are not completely satisfied with your purchase, we offer a refund, exchange or replacement on all goods returned within fourteen (14) days of your receipt of goods provided they are in their original, unopened and unused condition.
The item must be returned and received back to us within 14 days of purchase date complete with receipt or proof of purchase. The item must be in its original packing, and both item and packing are in original condition.
When an item is returned, a refund will be created for you for the value you paid for the item less any shipping costs.
If you require an exchange, please download a returns / exchanges form from the website and complete and return it with your item within fourteen (14) days of your invoice date. Shipping costs for sending the new item to you will be calculated and a Paypal invoice will be sent to you to cover the shipping costs. Exchanges after fourteen days are at the discretion of Supreme Products. Please contact the office on email@example.com to discuss.
Our products are covered by six (6) month warranty against faulty workmanship. If you believe an item is faulty, please return it to Supreme Products, PO Box 594, Pukekohe, 2340 with a returns and exchanges form. Once inspected and if deemed faulty, we will contact you to discuss the course of action we will take to resolve the issue.
Items damaged in transit will be replaced at our cost. Please contact the office on firstname.lastname@example.org with digital images of the damage (include images of outer packaging if appropriate). We may require the item to be returned prior to refund or replacement.
Use of your personal information
Your information will not be passed to any third parties. Your personal information will only be used for the purpose of facilitating your order or to contact you with an enquiry.
You indemnify and hold Supreme Products and its employees free from any damage, loss, or expense (including without limitation, attorneys' fees and costs) incurred in connection with any third-party claim, demand or action ("claim") brought against Supreme Products or its employees arising out of any of the following:
(a) any activity relating to your internet account, including negligent or wrongful conduct by you or anyone using the website through your internet account;
(b) your breach of any provision of these Terms and Conditions;.
Exclusion of warranties and liability
To the extent permitted by law, and without limiting your rights under the Consumer Guarantees Act 1993, Supreme Products excludes all:
(a) warranties, conditions and representations whether express, implied, statutory or otherwise, relating in any way to the website, your use of the Website and the information, products supplied, offered to be supplied or advertised or accessed through the Website; and
(b) liability (including for negligence) to you or anyone else in respect of any loss or damage (including special, indirect or consequential loss or damage), costs and expenses suffered by you or claims made against you arising from or in connection with your use of the website and the information, products supplied, offered to be supplied or advertised or accessed through this website for any reason whatsoever (including negligence).
Our maximum aggregate liability for any Product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the Product(s) in question.
You agree that if the Products are acquired for the purposes of a business, the provisions of the Consumer Guarantees Act 1993 are excluded in relation to those Products.
Miscellaneous and force majeure
You shall not assign or transfer any rights and obligations under these Terms and Conditions whether in whole or in part without the prior written consent of Supreme Products. Any unauthorised assignment shall be deemed null and void.
If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and Conditions and the remainder of the provisions in question shall not be affected thereby.
Supreme Products reserves the right to change the Terms and Conditions at any time.
No failure or delay by a party in exercising any right, power or privilege under these Terms and Conditions will operate as a waiver thereof, nor will any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other such right, power, or privilege.
Supreme Products shall not be liable for any delay in performing any of its obligations under these Terms and Conditions if such delay is caused by circumstances beyond our reasonable control and Supreme Products shall be entitled to a reasonable extension of time for the performance of such obligations.
These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand and shall be subject to the non-exclusive jurisdiction of the courts of New Zealand.
Delivery charges will be displayed at time of check out. Please note that our courier company cannot deliver to a P.O. Box or Private Bag Address.
